A cookie banner is the notice that informs website visitors about the cookies in use when they first arrive and asks for their consent before any cookies that are not strictly necessary may be set.
In practice
The yardstick is a genuine freedom of choice: accepting and rejecting should be equally easy to reach, and no setting should be pre-selected as "accept all" – under Article 4(11) GDPR consent is only valid if it is given by a clear affirmative act, and a pre-ticked box is not one. For storage that is strictly necessary on technical grounds, such as a shopping basket or a login session, Section 165(3) TKG 2021 provides an exception from the consent requirement; the Austrian data protection authority reads that exception narrowly, so borderline cases have to be assessed individually.
